What governs a Nebraska directive
Nebraska's healthcare-directive statute is at Neb. Rev. Stat. §30-3401 et seq. The official form is the Power of Attorney for Health Care. Your directive is valid the moment it's signed under your state's witness and notary rules above; it only takes effect if your physician determines you can't make or communicate decisions yourself.
Who can witness your Nebraska directive
Under Neb. Rev. Stat. §30-3405(1)(a), I am NOT the principal's spouse, parent, child, grandchild, sibling, presumptive heir, known devisee, attending physician, mental health treatment team member, romantic or dating partner, or attorney in fact (which under §30-3402(3) includes a successor attorney in fact), and I am NOT an employee of a life or health insurance provider for the principal. Under §30-3405(1)(b), no more than one of the two witnesses may be an administrator or employee of a health care provider who is caring for or treating the principal.
