What governs a Minnesota directive

Minnesota's healthcare-directive statute is at Minn. Stat. §§145C.01-145C.16. The official form is the Health Care Directive. Your directive is valid the moment it's signed under your state's witness and notary rules above; it only takes effect if your physician determines you can't make or communicate decisions yourself.

Who can witness your Minnesota directive

Minn. Stat. §145C.03, subd. 3(a): a health care agent or alternate health care agent appointed in the directive may not act as a witness or as the notary public for its execution. Under §145C.03, subd. 3(b), at least one witness must not be a health care provider providing direct care to the principal on the date of execution, or an employee of such a provider; a person notarizing the directive may be an employee of such a provider. Minnesota imposes no other witness disqualification. Two witnesses neither of whom is such a provider or employee satisfy subd. 3(b) on both signature lines.
