What governs a Texas directive
Texas's healthcare-directive statute is at Tex. Health & Safety Code §§166.001-166.166. The official form is the Medical Power of Attorney (MPOA). Your directive is valid the moment it's signed under your state's witness and notary rules above; it only takes effect if your physician determines you can't make or communicate decisions yourself.
Living will companion in Texas
The Directive to Physicians and Family or Surrogates, sometimes called a living will, records your treatment preferences directly for your doctors. The companion Medical Power of Attorney appoints your healthcare agent; this directive states what you want done if you have a terminal or irreversible condition and cannot speak for yourself. See Tex. Health & Safety Code §166.033.
Who can witness your Texas directive
I declare under penalty of perjury that the principal is personally known to me, that the principal signed or acknowledged this Medical Power of Attorney in my presence, that the principal appears to be of sound mind and under no duress, fraud, or undue influence, and that I am not the person appointed as agent by this document. I am not related to the principal by blood or marriage. I would not be entitled to any portion of the principal's estate on the principal's death. I do not have a claim against any part of the principal's estate after the principal's death. I am not the attending physician of the principal or an employee of the attending physician. I am not an employee of a health care facility in which the principal is a patient. I am not an employee of an inpatient mental health facility.
