Recording your North Dakota POA
North Dakota requires (or permits) recording of the POA at the office of the county recorder in the county where the property lies when it covers real property. See N.D. Cent. Code §47-19-03 (execution must be established, ordinarily by acknowledgment, before an instrument can be recorded), §47-19-07 (an instrument entitled to record is recorded by the recorder of the county where the real property is situated) and §47-19-44 (a recorded power to convey real property is revoked only by a revocation that is itself acknowledged or proved and recorded in the same office).
Recording isn't required for a POA used only for financial accounts, but it's needed before your agent can sell, lease, or mortgage real estate on your behalf.
