Recording your North Dakota POA
North Dakota records an instrument only once its execution is established, ordinarily by acknowledgment (N.D. Cent. Code §47-19-03), with the recorder of the county where the property is situated (§47-19-07). A recorded power to convey real property is revoked only by a revocation that is itself acknowledged or proved and recorded in the same office (§47-19-44). None of the three sections requires the power of attorney itself to be recorded.
The recording office is the office of the county recorder in the county where the property lies. See N.D. Cent. Code §47-19-03 (execution must be established, ordinarily by acknowledgment, before an instrument can be recorded), §47-19-07 (an instrument entitled to record is recorded by the recorder of the county where the real property is situated) and §47-19-44 (a recorded power to convey real property is revoked only by a revocation that is itself acknowledged or proved and recorded in the same office).
