Recording your North Carolina POA
North Carolina requires (or permits) recording of the POA at the register of deeds in the county where the property lies when it covers real property. See N.C. Gen. Stat. §47-28(a) (recording of a power of attorney governed by Chapter 32C used to authorize a transfer of real property; the POA or a certified copy must be registered with the register of deeds before the transfer instrument is executed by the agent). §32C-1-106 governs the validity of out-of-state POAs in North Carolina and does not address recording for real-property transactions..
Recording isn't required for a POA used only for financial accounts, but it's needed before your agent can sell, lease, or mortgage real estate on your behalf.
