Recording your Tennessee POA
Tennessee lists powers of attorney authorizing the sale, transfer or conveyance of real or personal estate among the writings that may be registered (Tenn. Code §66-24-101(a)(2)). To be registered, the signature is acknowledged according to law or proved by at least two subscribing witnesses, and the register may refuse an instrument that is not (§66-22-101(a)). Neither section requires the power to be registered before the agent acts.
The recording office is the Register of Deeds in the county where the property lies. See Tenn. Code §66-24-101.
